By downloading, installing, or using the SmartScraper Chrome extension or accessing our website at trysmartscraper.com (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update or modify these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will update the effective date at the top of this page when changes are made.

2. Description of Service

SmartScraper is a Chrome browser extension that extracts publicly visible business listing data from Google Maps search results pages. The extracted data — which may include business names, phone numbers, addresses, websites, ratings, review counts, and review snippets — is packaged into a downloadable CSV file stored locally on your device.

SmartScraper operates entirely within your browser. No user data is collected or transmitted to our servers as part of the extraction process.

3. Eligibility

You must be at least 18 years of age to use SmartScraper. By using the Service, you represent and warrant that:

•       You are at least 18 years old

•       You have the legal capacity to enter into these Terms

•       You will use the Service only for lawful purposes

•       Your use of the Service does not violate any applicable laws or regulations in your jurisdiction

4. Permitted Use

SmartScraper is intended for legitimate business prospecting and lead generation purposes. You may use the Service to:

•       Build prospect lists for cold outreach, sales, or marketing purposes

•       Organize and export publicly available business contact information

•       Conduct market research using publicly available data

You agree to use all data extracted using SmartScraper responsibly and in compliance with applicable laws.

5. Prohibited Use

You agree not to use SmartScraper or any data extracted through it for any of the following purposes:

•       Sending unsolicited communications in violation of anti-spam laws (including CAN-SPAM, CASL, or GDPR)

•       Harassing, threatening, or abusing any individual or business

•       Violating Google's Terms of Service or any other third-party terms of service

•       Reselling or redistributing extracted data as a standalone data product without appropriate permissions

•       Any unlawful, deceptive, or fraudulent purpose

•       Attempting to reverse engineer, decompile, or modify the SmartScraper extension

•       Scraping or extracting data in a manner that disrupts or overloads Google Maps or any third-party service

We reserve the right to terminate your access to the Service at any time if we determine, in our sole discretion, that you are violating these Terms.

6. Third-Party Terms & Google Maps Compliance

SmartScraper extracts data from Google Maps, a third-party service. Your use of SmartScraper in conjunction with Google Maps is also subject to Google's Terms of Service, available at https://policies.google.com/terms.

You acknowledge and agree that:

•       You are solely responsible for ensuring your use of extracted data complies with Google's Terms of Service

•       SmartScraper is an independent tool and is not affiliated with, endorsed by, or sponsored by Google

•       Google may change the structure of Google Maps at any time, which may affect the functionality of SmartScraper

We make no representations that the use of SmartScraper to extract Google Maps data is permitted under Google's Terms of Service. It is your responsibility to determine whether your intended use is compliant.

7. Intellectual Property

The SmartScraper extension, website, branding, and all associated content are the intellectual property of SmartScraper and are protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the SmartScraper extension for personal or business use in accordance with these Terms. You may not:

•       Copy, reproduce, or distribute the extension or any part of the Service

•       Modify, adapt, or create derivative works based on SmartScraper

•       Use SmartScraper's name, logo, or branding without our prior written consent

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SMARTSCRAPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

•       IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT

•       WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

•       WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA EXTRACTED THROUGH THE SERVICE

We do not warrant that the data extracted from Google Maps is accurate, current, or complete. Business listings on Google Maps are maintained by third parties and may contain errors or outdated information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMARTSCRAPER AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

•       Loss of profits, revenue, or business opportunities

•       Loss or corruption of data

•       Costs of procurement of substitute goods or services

•       Any claims arising from your use of extracted data in violation of applicable laws

Our total liability to you for any claim arising from the use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $10 USD if no payment was made.

10. Indemnification

You agree to indemnify, defend, and hold harmless SmartScraper and its owners, affiliates, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

•       Your use of the Service

•       Your violation of these Terms

•       Your violation of any third-party rights, including Google's Terms of Service

•       Your use of data extracted through SmartScraper in violation of applicable laws

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may also release updates to the SmartScraper extension from time to time. It is your responsibility to keep the extension updated for optimal performance and security.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising out of or in connection with these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration or resolved in the courts of the jurisdiction in which SmartScraper operates, as applicable.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmartScraper regarding your use of the Service and supersede any prior agreements or understandings, whether written or oral.
